Think of a woman in her last few months of pregnancy climbing up a ladder, and I think you'll get the idea. If she should fall, a jury would probably be a lot more sympathetic because she is with child. Furthermore, even though the US doesn't mandate paid maternity leave, my guess would be that women are still statistically more likely to take the unpaid leave than men and for longer time periods, thus leaving companies scrambling for somebody to fill in these time slots. I know from my dad, who was once a store manager, that there are often two types of hiring policies even for large corporations. They have a policy on paper, but then they have a spoken policy dealt out by regional managers or store owners which frequently contradicts the written one. For example, you know how job applications always ask you if you've committed a felony, and that you won't necessarily be disqualified because of it? That was complete BS at my dad's company and your app goes in the throwaway pile immediately. It's like the first thing they check for. Again, it's because you are a potential liability as a former criminal. And because of that, he's reluctant to hire them. Yeah. Needless to say, he wasn't invited back the next year (UCD's vet program is around 85% female). In the legal field, more than 50% of law school graduates are women. More than 40% of the lawyers hired by large firms are women. Fewer than 20% of lawyers promoted to partner are women (last I heard, there wasn't a single firm in the nation that was above the 30% figure).
