Overview of Issue

The owner of this company has made a legal threat against another wiki editor: "i want u to calculate how much u have cost me and my business before i take any legal action about it." and " did not give u any ride, i did not transact any business with u,and above all calrecycling is not taxi business i dont know why u posted it in my taxi business page maybe u will explain it better to the legal source when the time comes." —cp

  • Fact is Andrew has been nothing but a thorn in the side of this Wiki. I suspect Andrew doth protest too much...be that as it may. My question: Can the accusation of garbage-sifting be confirmed that it was their staff?? If yes then it stands. If not then I'm afraid Wes shouldn't have posted it. The statement is borderline for me. PeteB
  • While I'm inclined to agree, it's vague. Could a couple other editors please weigh in? (Pete - are you saying the legal threat is borderline, or Wes's comment?)
    • No the legal threat is absolutely preposterous. Wes has clarified a little bit: "Secondly you or another male employee and your female employee were digging through the trash at the gas station". Again how do we know it was their staff? Did they pull up in a 24 Car?? Sorry I need more evidence that it was them—otherwise the accusation comes off as a bit vague. -PeteB
    • I'm tired of Andrew's ridiculousness. I let him have his way before because he's legally threatened me before with this on my page, "well scott it is very unfair that you just came back to wiki and starts slandering my name and my business for nothing. do you know how much i lost on my business since you put this topic online? well again, i won't blame you rather it is wiki. BUT dont forget that LIABLE [sic] is against law.." And so I just let him delete whatever, even though all I had done was aggregate the comments of other people.       • It was from June 4, 2012. It's not directly relevant to the most recent threat, but I just wanted to note that this is his usual behavior whenever anyone posts something negative about his business. And then on the 5th of June he wrote, "Scott, i dont care about any body being sympathic to me, what i care fair treatment, i want that ACCUSATION posted in my front business page being removed within 24 hours otherwise i will be mad." I refuse to engage with somebody who talks like that. -SM

  • Where is his commercial recycling license for CALRECYCLE? You can only recycle so much before you are required to get one -SD
    • Wes, did you just recognize the people as 24/7 drivers, or did they park a 24/7 cab(s) there? If it's just the same people, I'd say relevance to this page is slim. If they drove up a 24/7 cab(s), parked, got out, rooted through the trash, took recycling out of the trash, and put it in the cab, that seems quite relevant to potential customers. Some would probably like the idea that 24/7 is preventing recyclables from going to the landfill, while others would probably be grossed out. —TG

        • It looks like it's unlawful without a permit pursuant to Davis Municipal Code section 32.01.030(b). The penalty is unspecified in that section, which appears to mean that it's governed by DMC §1.01.110, which provides in relevant part:

[W]here no specific penalty is provided therefor, the violation of any such provision of this Code or any other ordinance of the city or any such rule or regulation shall be punished by a fine not exceeding one thousand dollars or imprisonment for a term not exceeding six months, or by both such fine and imprisonment. Such violations may also be redressed by civil action.

The fact that the individual called back to cancel when the other cab did arrive is more than many would do and should be something to be considered as a courtesy as it occurs.so rarely. —Wes-P

2012-11-13 15:36:07   Andrew: Legal threats are not acceptable on the Wiki. Due to your multiple legal threats, a proposal has been made to ban you from the Davis Wiki (at least temporarily). You can view it at 24/7 Taxi Cab Company/Talk. In the words of Ken White, "vagueness in legal threats is the hallmark of censorious thuggery." If you have a problem with content on the Wiki, you need to address it in the proper way. On the Wiki, that means following community guidelines. See Wiki Community/Handling Problems for details. If you feel the need to use the legal system, that is up to you. But the Wiki is not the place to make those threats. Talk to a lawyer if you think you have a case, and tell him/her to be sure to brush up on 47 U.S.C. § 230 and CCP § 425.16 et seq. —PeteB

Proposal(s)

PROPOSAL: I recommend a temporary ban of AndrewNodim. Reasons: 1) Repeated legal threats against users 2) People have repeatedly tried to work with him in the past and he has clearly not been interested. Temporary ban to last AT LEAST 2 months—if he returns in the same vein/attitude, make it permanent. We can only try so much to work with someone who won't even try to return the interest. PeteB

I agree on the temporary ban. I don't have a view about the appropriate length of time. —cp

I'm not opposed to a temporary ban, but I'm not sure how much good it's going to do. Bans are usually useful for cooldowns and whatnot. This isn't a rapid-fire problem needing an immediate response and a cooldown. Rather, it seems like a long-term pattern, with months passing in between events. Thus I'm skeptical that a temporary ban will make much of a difference. We might be better off with an ultimatum on the legal threats. Something to the effect of:

"Legal threats are not acceptable on the Wiki. If you continue to make legal threats, you may be banned from the Davis Wiki. In the words of Ken White, "vagueness in legal threats is the hallmark of censorious thuggery." If you have a problem with content on the Wiki, you need to address it in the proper way.     • We have multiple people in agreement with my proposal and earlier he wiped out comments from this thread. Now he posts a rude comment that is nothing more than an insult. Please act on the proposal. PeteB

2012-11-14 12:43:11   Hey, Andrew... it does look to most people like you're threatening people on the wiki with legal action. Please don't do that. If you feel you have a case against somebody, do feel free to use the legal system, but please don't make threats on the wiki. It's not an appropriate place for such things, and it is a form of bullying and intimidation. I'm not trying to insult or work against you, merely lay things out so you can understand what people are responding to. I know you're frustrated with Wes, but we need to keep the space we're all communicating in open to everybody. Are we good? —Evan 'JabberWokky' Edwards

2012-11-14 14:41:43   Andrew, is it accurate to say that 24/7 driver(s) pulled up to the service station in their 24/7 cabs and went through the trash looking for recycling as a part of your recycling business? That's the sort of thing that gets documented on the wiki. Some readers will think it's a good thing - drivers for the company are helping prevent recyclables from going to the landfill. Some readers will think it's a bad thing.

The important part from the wiki perspective is simply whether it's true. If it is accurate, that's information that should be on the wiki. There should also be information about your recycling business - it's an explanation of why drivers go through the trash for recycling and also an additional piece of information about the 24/7 company (related companies, employees of 24/7 doing work for the recycling company, etc.).

I don't know whether Wes or anyone else has a grudge against you. But speaking from the perspective of someone who's only interested in the wiki's value as a resource for people in the Davis community, as long as it's true I think it should be listed - with all of the context necessary to explain why drivers were going through the trash. —TomGarberson

This is Cocoa and i am a 24-7 Taxi Cab Company Driver and I am also Andrew's fiance. Because i live with Andrew and we use the same computers you will all say whatever you want. We don't care. We have nothing to prove to you and we don't have to answer anything to any of you. Everything that has been said about our company has only been to discourage any customer's from using our service. I have never heard so many lies. I have never came to this wiki and told all the hearsay that i have heard in the 2 years i have been driving taxi in Davis about what and how some customers have been treated and talked to from the other taxi driver's from the other davis taxi companies and yet God keeps on blessing us. We don't care about any of your opinions since you have never rode in any of our taxi's.AS FOR YOU Wes-P, if you want to talk about anyone picking recycle from the am/pm. FROM WHAT I HAVE SEEN IN THE BATHROOM, I BELIEVE IT'S MUCH MORE DISGUSTING YOU SCRUBBING THE TOILETS THERE. It seems when someone is not happy in there own life they want to try to bring someone else's down. It seems you may have a little bit tooo much time on your hands. Anywhooo, i don't care what you say and we are toooo busy for any of this wiki nonsense. So have at it because anything you wikians say from here on about us, we have many and much more important things we are doing and we don't have time to sit around and involve ouselves in this ridiculousness. By his and Cocoa's comments it is obvious they don't wish to consider anything anyone on this Wiki has to say.
